In order to protect landowners who make their lands available for recreational uses by the public, Vermont has passed legislation limiting the liability of such landowners. This includes the use of private property for snowmobiling. When a landowner makes their land available for recreational purposes, and does not charge a fee to the users, Vermont law provides that the landowner shall not be liable for any property damage or personal injury arising from the use of the land, unless the landowner intentionally causes the property damage or personal injury. As a result, the landowner is not presumed to have made any assurance that the land is safe for recreational uses, nor does it create any duty on a landowner of land to inspect the land to discover any dangerous conditions. Thus you, as a member of Vermont Association of Snow Travelers (VAST), when using any of the trails which constitute the Statewide Snowmobile Trail System (SSTS) use the SSTS at your own risk. You must take care to use them with caution and due regard for your own safety and that of others using the SSTS. You agree that neither the landowner, VAST, or local VAST affiliated club, has made any representation or assurance to you as to the relative safety or condition of the SSTS and that neither VAST, or local VAST affiliated club nor the landowner are obligated to maintain the SSTS in a safe condition or to inspect the SSTS for safety purposes. I declare that I am responsible for my use of SSTS in conformance with the snowmobile laws and rules of the State of Vermont and willingly accept all the risks inherent in such use.
I expressly acknowledge and accept that snowmobiling is an inherently dangerous activity and pursuant to VT ST T. 12 § 1037, “a person who takes part in any sport accepts as a matter of law the dangers that inhere therein insofar as they are obvious and necessary.” I acknowledge that snowmobiling, is an off-road experience and I may encounter debris, trees, rocks, animals, weather conditions and that trail conditions may change without warning and that all of the foregoing are obvious and necessary to the sport of snowmobiling. I acknowledge that trail signage is not a legal requirement and that neither VAST nor the landowner have a duty to provide signage warning of potential trail hazards. When signage is provided, it is primarily for directional purposes and VAST has used reasonable care in so marking the SSTS. The provision of certain safety related signs, such as stop signs at certain intersections, does not impose a duty on VAST, local VAST affiliated club or a landowner to mark all safety hazards. I further acknowledge that I will always stay on VAST designated riding areas and trails within the SSTS. No VAST designated riding areas or trails within the SSTS cause a rider to cross any frozen body of water; accordingly, if I do so cross any frozen body of water, I represent and warrant that I assume all personal responsibility, no matter the circumstance, including whether I have done so on my own, where led by others, or if leading others. When using the SSTS, I assume all risk of personal injury, death or property loss resulting from any cause whatsoever, including, but not limited to the risks, dangers and hazards of and inherent to snowmobiling and as a result, neither VAST, the local club nor the landowner shall be liable for any such personal injury, death or property loss.
Based upon the foregoing, by selecting “I Accept” below, I hereby agree to release, hold harmless, and forever discharge the Vermont Association of Snow Travelers (“VAST”), any local snowmobile club, the landowner(s), any officers, directors, officials, agents, representatives, volunteers, and/or employees of all of them, for and from any liability, loss, claim, lawsuit, damages, personal injury, including, but not limited to, paralysis or death, or property damage which may accrue or relate in any way to or from the undersigned’s use of the SSTS, including, but not limited to VAST, any local club, or landowners’ negligence and/or failure to use reasonable care in creating, designing, maintaining, signing, cleaning, or otherwise providing upkeep on the SSTS, and/or participation in the sport of snowmobiling as generally described above. The undersigned further states that he/she knows the risks and dangers to himself/herself and his/her property while upon the SSTS and/or while snowmobiling. I acknowledge, in reliance upon his or her own judgment and ability, that I assume all the risk(s), loss, claims, damages, personal injury, including, but not limited to, paralysis or death, or property damage from any cause including, but not limited to VAST, any local club, or landowners’ negligence and/or failure to use reasonable care in creating, designing, maintaining, signing, cleaning, or otherwise providing upkeep on the SSTS. I also represent, warrant, and agrees that that neither VAST, any member club, nor any landowner shall bear any liability for any loss, claim, lawsuit, damages, personal injury, including paralysis or death, or property damage he or she may suffer while using the SSTS and/or while snowmobiling.
