I personally do not care if the animals were wild or owned by someone! These guys intentionally(and knowingly) did what they did and should now deal with the consequences of their actions.

That would be a Defense Attorneys job to try to get his clients a better deal, he wouldn't be much of an attorney if he didn't.

Unless these are public defenders, I don't consider the lawyers much better then the people they are defending in this case.

I either,, However, if an Attorney didn't properly defend their clients they wouldn't be attorneys very long, they have a legal obligation to try to get all charges dropped or lowered.

UPDATE.........Judge granted the request for "OUT OF COUNTY JURY" to be brought in....Next court date is May 12....This PUNK has an extensive criminal history already...Also has a SERIOUS lack of respect for humans and animals....Maybe somebody can teach RORY some respect....Since the Wisconsin Court System has FAILED so far......Here's his address....

Felony charges dismissed in snowmobile deer kill

Jun. 12, 2009 12:54 p.m. | Waupaca - Five felony charges of cruelty to animals have been dismissed against a man accused of running over and killing some deer with his snowmobile.

Robby Kuenzi's attorney successfully convinced a Waupaca County judge Thursday that because the defendant was hunting at the time of the incident, state law prohibits animal cruelty charges.

Judge John Hoffman conceded and dismissed the felonies. Kuenzi still faces several ordinance violations and four misdemeanors, including hunting out of season.

Kuenzi's brother, Rory, and Nicholas Hermes faces similar charges. Four deer were found dead along a snowmobile trail south of Waupaca on Jan. 10, and a fifth had to be euthanized.

So a guy uses a snowmobile to herd deer and run them down, to spin the track on the deer once it's down, to tie one up to a tree, yet he has no gun or bow and the judge says this guy (and his buddies) was "hunting"?? WTF!!!!

How much is ol' Judge Hoffman getting under the table for this one??

Somebody refresh my memory...did they prove what time of day this happened? Hunting season closes at dusk, didn't these nimrods do this damage at night?

A caller to a Department of Natural Resources hotline helped investigators narrow the time of the attack to between 7 and 9:30 p.m. Friday, earlier than initially suspected.

dropped charges again!!!! this sucks for our sport. damage was done and who know who will forget that a snowmobiler ran deer over. said they were hunting??

The investigating officers, and the prosecutor are the ones to balme for these douchebags getting off totally free! They are the ones that need to be dealt with right now. the offenders will get what they have coming to them one way or another, And I am betting jail would have been easier on them.

The prosecutor screwed up and charged the offenders with the wrong charges, if they would have researched their options better and pulled their heads out of their asses, they would have had a watertight case against these deer terrorizing douchebags.

Anyone got pictures of the offenders they can post online?? this way we will know them if we see them!

This is just a dam shame. Hopefully this follows these fuckers for the rest of their lives. How can a judge let them off like that what a horrible precedent they set. Judge and prosecutor really fucked this one up bad.

WUAPACA, Wis (WSAU) We could find out in June whether animal mistreatment charges will be re-instated against three Waupaca County men accused of killing deer with their snowmobiles. Rory-and-Robby Kuenzi and Nicholas Hermes were charged with both criminal mistreatment and hunting violations. But two circuit judges dropped the felony counts, saying the law exempts hunters from animal mistreatment charges.

The state Justice Department appealed those rulings. A county prosecutor says all the paperwork has been filed, and he expects the appeals court to rule on the matter within 90 days.

Authorities said the Kuenzis and Hermes killed a half-dozen deer for the thrill of it. It happened in January of 2009 on a snowmobile trail in Waupaca County.

Meanwhile, a bill is pending in Madison to give the same penalties to thrill-killings as to animal cruelty. And those hitting wild animals with off-road vehicles would have to report it to the police. The bill was in response to the Waupaca County incident, as well as the later killings of ducks at Fond du Lac and Fort Atkinson.
