After reading your quote again, I am still quite perplexed that you think I am the one who is wrong here. I thought about it and I am certain you are missing a few facts about this situation, so I will enlighten you.
When this sled blew up the second time in just a smidge over 100 miles Mike told me then, and the first time that it blew that the sled was purchased as is. That statement was not true at that time, and is not true today either. Just another lie to try to avoid a blatent mistake by the people in the service department. I paid for the repairs the first time and I should not have had to do that when it blew after 7 miles, count them 7, but it was my fault that he sold me a dead sled. I paid more than the agreed deal that Mike made when the engine siezed because when I went to pick it up they threatend to start charging me storage if I did not pay. I did not cancel the portion of the payment made by credit card for almost two months after A) Mike told me to sue him, B) his attorney sent me a letter stating that all correcpondence was to go through him, and him only, and C) their Attorney refused to fix anything unless I agreed to pay more money.
That is when my credit card company started to put me through the wringer. I had to produce from an expert witnesses that could substantiate my claims that the work performed was faulty, I did that. After sending numerous faxed documents to them substantiating my claim they finally honored my request and reversed the charges. So now I also have time and expense to have this expert witness prepare the information, diagnose the sled, and hold it because of the legal issues that surrounded this entire deal.
Along comes August of 2006 and I am just wanting to get out from under this whole deal and the sled is sold. No word from B&M, No word from his Attorney, sled is not getting fixed, nothing happening. Then without any warning, no conversation from Mike, his Father, their Attorney, not a word about this for months, I get served with court papers. They want their thousand bucks, but no word other than I am still responsible for more money beyond that if I have any thought of that sled ever running again. So much for the sled being sold.
So here I was trying to get this whole deal behind me and now they have gone two years of Attorneys fees and twice I offered their Attorney to just drop this whole thing and walk away. He came back to me both times and said that they still want my thousand. The absurdity of this is out of hand, I am the one who has to travel 4 hours round trip everytime their is a court date. Mike, anyone from B&M, never there, just their Attorney.
Thare is obviously much more to this story, I am just sick of what they did to me, to many others, and what they will continue to do to people in the future, and I still am looked at as the bad guy on this deal, and B&M has caused every bit of this. And Mike has the balls to whine to people that I am the one attacking him. Well folks I am here to tell you today, tomorrow, and whenever, Mike has brought this whole situation upon himself. Had he not filed the initial paperwork and sued me, we would not even be looking at a post like this.
