The Phillips City Council responded last week to petitions seeking to curtail snowmobile use on city streets.
The petition called for a reduction in the authorized hours of operation for snowmobiles in Phillips, either by council adoption or by referendum vote.
Currently, the city code forbids snowmobile operation from 11:30 p.m. to 6:30 a.m. The petition called for a revised ordinance forbidding snowmobile use from 10 p.m. to 8 a.m.
In either case, the prohibited hours relate to operation between two points within the city limits. However, direct access to outlying trails is open 24-hours per day by state law.
The petition met procedural requirements under state statutes governing direct legislation. But the council rejected the petition on the advisement of city attorney Bruce Marshall, who argued that the law does not allow direct legislation when a similar municipal ordinance is already in place.
